Notice of Claim Procedure
Claim means any civil Litigation in a state or federal court of law.
As a condition precedent to any coverage provided by the applicable ARMS Coverage Agreement, a Member board must give written notice to ARMS or its designee within 15 days of service of any Claim on a Member. ARMS coverage will not apply to a Claim reported more than 15 days after receipt by any Member.
As a condition precedent to any coverage provided by the applicable ARMS Coverage Agreement pursuant to the Special Extended Reporting Period provisions, a Member board must give written notice to ARMS or its designee within 15 days of service of any Claim against adult, non-student Employees, as defined in the Coverage Agreement, when such Claim arises solely and exclusively from Incidents that occur in whole prior to 12:01a.m., July 1, 2013. ARMS coverage will not apply to a Claim reported more than 15 days after receipt by any Member or Employee.
To report a Claim a Member board must simply provide a copy of the Summons and Complaint served on any Member or Employee, as applicable, to the following:

A Member nor representative or agent of a Member, including an Employee benefiting from coverage under the Special Extended Reporting Period provisions of the applicable Coverage Agreement must not admit liability, offer to settle any Claim, incur any cost, or retain any attorney, the cost of which the Member expects ARMS to pay.
Please do not report Incidents until Litigation is instigated in a state or federal court of law and a Summons and Complaint have been served on the Member.
